After a car accident, you will almost certainly receive a call from an insurance adjuster. They will sound friendly and helpful. They are not on your side.
What an Adjuster’s Job Really Is
An adjuster’s primary role is to investigate the claim and minimize the payout. They are trained negotiators who handle hundreds of claims per year. Most accident victims speak to them once in their lives. That information asymmetry is enormous — and insurers exploit it.
What You Should Never Say
- “I’m fine” or “I don’t think I’m hurt.” Injuries may not be apparent for days. This will be used to dispute future medical claims.
- “I’m sorry” or “It was partially my fault.” Even a casual apology can be used as an admission of fault.
- Agreeing to a recorded statement before speaking to an attorney. You are generally not required to give one to the other party’s insurer.
Watch Out for Quick Settlement Offers
Early settlement offers are almost always far below what your claim is worth. Once you accept and sign a release, you cannot come back for more — even if your injuries turn out to be more serious than initially thought.
Your Best Protection
Consult with a Texas personal injury attorney before speaking extensively with any insurance company. Most offer free consultations and only get paid if you win.
